Between 2012 and 2021, the study found that reckless or careless driving was the top charge, with 23,663 drivers facing this serious accusation out of 507,728 involved in deadly crashes. This represents 4.6% of drivers in fatal accidents. Colorado, Nevada and New Jersey top the list of states where these charges occur most often.

License and registration violations

The second most common violation pertains to license and registration offenses, such as driving with a suspended license. In the period studied, 3.9% of drivers in fatal crashes were charged with such violations.

New Hampshire, Washington and Delaware reported the highest instances of these offenses, spotlighting the need for stricter adherence to licensing laws and regulations.

Impairment and beyond

Impairment due to alcohol or drugs is another leading cause for charges, with 3.9% of drivers in deadly collisions facing such accusations. Nevada, Delaware and North Dakota are the top three states for these charges.

Beyond these top three violations, drivers in fatal crashes also face charges for improper turning, driving on the wrong side of the road, speed-related offenses and ignoring traffic signs. Many of these violations lead to death or significant injuries, requiring expensive medical treatment and long-term rehabilitation.
