What Are Damages?
One of the big issues in personal injury cases are “Damages”. What are damages? What does that mean? Damages are the things that you are entitled to recover if you are hurt and are the innocent victim due to someone else’s negligence. Damages consist of several things. One of those are your medical bills. Those are a portion of damages. You are entitled to recover the value of your medical bills. You are also entitled to recover any time you miss from work: lost wages or lost earnings. You are entitled to recover that amount of money. You are also entitled to recover from your pain and suffering that you’ve been through due to someone else’s negligence.
All of the physical and mental pain and suffering that you’ve been through is a number that you are entitled to recover. That number ranges based on the extent of your injury. If it’s a very serious injury, that number goes up. That is something that is ultimately, if we can’t resolve the case through settlement, determined by a jury. And, we are willing to take it there to maximize that value. You also may be entitled to recover punitive damages if you have a defendent, the person that casued this injury, do something so grossly negligent they need to be punished.
